Whenever a government or the judiciary needs to brag about
its effectiveness and efficacy; they make the common man a scapegoat. This time
the residents of Campa Cola compound are the chosen ones. The notice of the
demolition should have gone to the builder who has flouted the norms and he should
be made responsible to provide alternative housing solutions to the residents
of its illegal construction before the same is being razed. There should be a
difference in the modus operandi adopted in demolishing the illegal constructions.
The residents cannot be treated on par with the demolishing drives to raze illegal slums. Unlike the latter, the residents did not illegally engulf
a space but have purchased the apartments. During the purchase, residents claim
that no illegalities were shown. They claim to have paid regular property
taxes, and municipal taxes. The solution to curb the menace of irregular
constructions lies in punishing the perpetrators of the crime, who are the
developers and builders and not the residents. Before demolishing any illegal
structures, the developers and builders should be held responsible to provide
alternative permanent residences which are on par with their current habitat.
 

Looking at the current political scenario In India, 4 things could have saved Campa Cola Residents from being
victims:
1.      
OCCUPANCY OF SOME OF THE FLATS BY POLITICIANS,
BMC OFFICIALS OR DAWOOD IBRAHIM. The occupancy of some of the flats by
politicians could have stretched the issue for many years just like Adarsh housing
society case and eventually a clean chit could have been granted. Occupancy of
flats by BMC official/s would have ensured that such an action would not have taken
in the first place. No government in Maharashtra (or India) or BMC has the
courage to disrupt around thousands of crores worth illegal properties of Dawood
Ibrahim in Mumbai.
2.      
THE ACCIDENTAL BURNING OR THE MISSING OF CAMPA
COLA FILES. Inspiration from missing Coalgate files, Kargil for profit scam
files, land deals files and the Slum Rehabilitation Authority projects could
have helped.
3.      
THE DISHARMONY BETWEEN THE OCCUPANTS ON THE
BASIS OF RELIGION OR LANGUAGE. This could have become a new pitch for the
political parties to flex their power muscles in displaying their concerns for
the respected vote banks. This ostentatious display of power might possibly
save the flats from being razed.

4.      
 A PLEA
FROM SOME EMINENT CHIEF JUSTICE OF INDIA or some retired judge of Supreme Court in the favor of the residents. An expert (like Sanjay Dutt who is on a parole, fortunately at this time)
can be invited to get the right person on board depending upon the quantity of funds the residents are willing to contribute.

As a law abiding common man who is always victimized by the
law, he is only left with the power of democracy to save and sustain himself. Let’s
hope that the residents of Campa Cola are able to make use of the power of
democracy and are not left merely waiting for the mercy of the law.
